Building on this momentum, the 5th Edition of the Unwanted Witness Privacy Moot Court Competition (2026) will focus on one of the most pressing emerging issues in the digital economy: data protection in digital financial services and fintech ecosystems.

By focusing on data protection in digital financial services, the 2026 edition seeks to:

  • Promote legal scholarship on emerging fintech regulation
  • Encourage critical examination of privacy risks in financial technologies
  • Foster regional cooperation among universities and future legal practitioners
  • Strengthen East Africa’s legal capacity to govern the digital economy

The 2026 edition will be hosted at Uganda Christian University (UCU), Mukono, and will bring together law students from universities across Uganda, Kenya, Tanzania, and Rwanda to engage in legal argumentation on complex privacy and financial technology issues shaping the region’s digital future.

Theme: “Protecting Personal Data in Digital Financial Services and Fintech Ecosystems in East Africa”

Digital financial services have transformed economic participation across Africa. Mobile money platforms, digital lending applications, fintech startups, and digital banking systems are rapidly expanding financial inclusion across the region.

However, these innovations also generate significant data protection and privacy challenges, including:

  • Extensive collection of personal and behavioral data
  • Algorithmic decision-making in credit scoring
  • Data sharing between financial institutions and third-party fintech providers
  • Cross-border financial data transfers
  • Risks of surveillance, profiling, and discrimination
  • Lack of transparency in digital lending and mobile financial platforms

The 2026 competition will examine how data protection laws, financial regulations, and human rights frameworks can safeguard individuals in the rapidly evolving fintech ecosystem.

Why Now

While these technologies improve financial inclusion, they also raise critical concerns around:

  • Unauthorized access to financial data
  • Exploitative digital lending practices
  • Data harvesting from smartphones
  • Lack of meaningful user consent
  • Weak accountability mechanisms for fintech actors

Lawyers and policymakers must therefore grapple with how data protection principles apply to financial innovation, ensuring that technological progress does not undermine fundamental rights.

Objectives

The competition aims to:

  1. Cultivate a deep understanding of privacy and data protection law among emerging legal professionals in East Africa.
  2. Encourage critical debate and innovative legal arguments around regulation of fintech and digital financial ecosystems.
  3. Promote regional dialogue on harmonizing data protection and financial governance frameworks across East Africa.
  4. Strengthen advocacy, legal writing, and oral argumentation skills among participating students.
  5. Highlight the role of legal practitioners in protecting digital rights within emerging digital economies.

The 2026 Unwanted Witness Privacy Moot Court Competition will recognise exceptional performances with awards such as:

  1. Overall Champion: $1,500, a trophy, medals, certificates, and a fully paid trip to attend the 8th Privacy Symposium Africa.
  2. 1st Runners-Up: $500, a trophy, and certificates.
  3. Best Overall Oralist: An accolade and a certificate.
  4. Best Written Submissions for the Applicant: An accolade and a certificate.
  5. Best Written Submissions for the Respondent: An accolade and a certificate.
  6. Each participant receives a certificate of participation.
