Impartiality of Judges

We understand that one of the most important aspects of any moot court competition is the assurance of impartiality and fairness in the proceedings. We want to assure you that the Unwanted Witness Privacy Moot Court Competition 2024 will be free of any form of judicial bias.

The judges presiding over the competition are selected based on their expertise and experience in the field of privacy law, and they have been instructed to conduct themselves with the utmost professionalism and objectivity throughout the competition.

To further ensure fairness, we have established clear rules and guidelines for the competition (link) that will be strictly adhered to by all judges, participants, and organisers. Any instances of potential bias will be immediately addressed and dealt with accordingly.

Here are some steps that have taken that will address any form of judicial bias:

  1. We have a clear Judge selection criteria: We have a diverse pool of Judges to mitigate the risk of bias and they are carefully selected on professional basis, taking into consideration their experience as well as good knowledge and understanding of data protection and privacy law. 
  2. Training of judges on impartiality: There will be a Judge’s briefing prior to the oral rounds in which they will be trained on the importance of impartiality and how to recognize and avoid biases. This training will include exercises and simulations to help judges identify and overcome their biases.
  3. An established Judge’s code of conduct: We have put in place a code of conduct to provide clear guidelines for judges on their behavior and responsibilities during the Unwanted Witness Privacy Moot Court Competition 2024. The code of conduct includes provisions on impartiality, fairness, and transparency.
  4. Monitoring and reviewing of judges’ performance: As the secretariat, we are going to monitor the performance of judges to ensure they are adhering to the code of conduct such as evaluating arguments and evidence objectively. We will gather feedback from Mooters and observers to identify any potential biases or areas for improvement.
  5. Addressing of bias promptly: We will ensure that in case of any allegations of bias, they will be addressed promptly and impartially. This will involve conducting an investigation and, if necessary, removing the judge from the competition.

Our ultimate goal is to provide a platform for the exchange of ideas and the development of legal skills in the area of privacy law, and we believe that a fair and unbiased competition is essential to achieving this objective.
